Terms and Conditions

By signing up to be a member of Tony’s Health and Fitness (or ‘gym’), you agree to abide by the fitness center’s terms and conditions, which include (but are not limited to) the following:

Membership

We offer multiple membership tiers and categories. When an individual chooses a category, they automatically agree to its costs and terms associated with the membership. The term “cost” entails membership fees, taxes, and additional fees (if applicable). The term of membership is the time period for which the membership plan is valid.

Some of our membership plans are recurring, so the members will be automatically charged for the next month’s enrollment unless they express their wish to cancel their enrollment at least seven working days prior to the subscription date.

Discounts and deals pertaining to a particular membership tier or type may not be applicable for a different membership type.

Health and Safety

The members are obligated to disclose any health conditions they may have that might prevent them from following a training program to its full extent. And by becoming a member, they indemnify the gym and trainers working at the gym from any legal or financial liabilities resulting from a condition they were unaware of.

Similarly, if a member develops a condition that prevents them from following through with their exercise routine, they are obligated to inform the gym and/or their trainer.

The members are also obligated to inform the gym about any allergies they may have, so the nutritional or supplemental recommendation may be adjusted accordingly. If a member fails to disclose this information, they automatically “clear” the gym from any potential liability stemming from any medical accident, or physical or mental harm, caused by diets or supplements provided or suggested by the gym. It also applies to dietary restrictions stemming from other medical conditions like cardiac diseases, diabetes, etc.

The members are prohibited from coming to the gym and coming in contact with other members if they have a contagious disease that can be passed on by sharing the same space and equipment. If they become aware of a problem after attending the gym, they are encouraged to inform their trainers or gym management so adequate warning can be passed along to other members.

Equipment Handling

Members are guided on the right method to use any equipment they access during their time at the gym. Any personal injury or damage to the equipment that results from the following will be the member’s responsibility/liability:

 

  • Failing to follow the instructions
  • Experimenting with the equipment
  • Intentionally damaging the equipment

If members are concerned with the state of any piece of equipment in the gym, they are encouraged to share this concern with their trainers or any gym staff. They will be directed to either refrain from using that equipment or will be assured of its integrity.

Conduct Within The Fitness Center

The members are expected to treat each other and the gym staff with respect and integrity. Negative comments about other gym members or staff members will not be tolerated. Any complaints about the use of equipment or space within the gym should be directed towards the staff members. Fights and loud disagreements that pollute the gym environment may result in immediate membership termination and even long-term blacklisting from the establishment (based on the nature and extent of the altercation).

 

Members are not allowed to take pictures within the gym unless they have explicit permission from gym staff members. If their photos include other members of the gym, they have to take permission from the individual as well.

Private Property

Gym members will be allocated lockers. The gym management will not be liable for any theft or damage to their private property when it’s not within the allotted lockers.

Privacy

The financial and private data shared with the gym, through payments, membership, and website accounts, will be kept private and safe in accordance with federal and state laws. The data may be shared with reputable third-party marketing companies for targeted marketing beneficial for the members.
